BRITS WATER FILTERS

Terms and Conditions of Sale

Date of issue: 20 August 2026

Revision Number: 1

These Terms and Conditions (“Terms”) govern every quotation, order, sale, delivery, installation referral and after-sales interaction between Brits Water Filters (“we”, “us”, “our”, “the Reseller”) and any person or entity that purchases goods from us (“you”, “the Customer”). By placing an order, paying a deposit, or accepting delivery of goods from us, you confirm that you have read, understood and agreed to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not proceed with a purchase and contact us first to discuss your concerns.

1. Definitions

1.1  “Goods” or “Products” means any water filtration, water purification, reverse osmosis, UV sterilisation or related equipment, parts, accessories or consumables sold by us.

1.2  “Supplier” or “Manufacturer” means the third-party manufacturer, importer or wholesale distributor from whom we source the Goods, and who remains responsible for the manufacture, quality and warranty performance of those Goods.

1.3  “Website” means any website, online store, or digital ordering platform operated by or on behalf of Brits Water Filters.

1.4  “Order” means a request to purchase Goods placed with us in person, telephonically, in writing, or through the Website.

2. Our Role as a Reseller

2.1  Brits Water Filters operates as an authorised reseller and distributor of water filtration and purification equipment. We do not manufacture the Goods we sell.

2.2  All product specifications, performance claims, and technical data are supplied to us by the relevant Supplier or manufacturer. While we take reasonable care to display accurate information, we cannot be held responsible for errors, omissions or changes made by the Supplier to product specifications, packaging or design.

2.3  Where a product is found to be defective, faulty, or otherwise not fit for purpose due to a manufacturing fault, the matter will, where required by the applicable warranty or by the Supplier's own policies, be referred directly to the Supplier or manufacturer of that product for assessment, repair, replacement or resolution. We will assist you in logging and following up on such a claim, but the final decision on a manufacturing-related claim rests with the Supplier.

2.4  Nothing in this clause 2 removes your statutory rights as a consumer under the Consumer Protection Act 68 of 2008, where applicable. We remain your first point of contact for all queries, and will facilitate communication between you and the Supplier where a claim must be referred.

3. Orders, Pricing and Payment

3.1  All prices are quoted in South African Rand (ZAR) and include VAT unless stated otherwise.

3.2  Where a product has been listed or quoted at an incorrect price, or with incorrect descriptive information, due to a typographical, systems, or supplier data error, we reserve the right to correct the error, cancel the order, or contact you to confirm whether you wish to proceed at the correct price before the order is processed.

3.3  We reserve the right to accept or decline any Order at our discretion, including where stock is unavailable, within a reasonable time of the Order being placed. If we are unable to fulfil an Order, any payment already made will be refunded in full.

3.4  Full payment is required before an Order is processed and dispatched, unless a separate written payment arrangement has been agreed with us. Ownership of the Goods only passes to you once payment has been received in full.

3.5  We reserve the right to refuse to provide goods or services to any person, at any time, for any lawful reason.

4. Delivery and Installation

4.1  Delivery timeframes provided at the point of sale are estimates only and are dependent on courier and Supplier stock availability. We will not be held liable for delays caused by courier services, load-shedding, weather, or circumstances beyond our reasonable control.

4.2  Where installation is requested, installations are carried out by a suitably qualified plumber or technician. It remains your responsibility to ensure safe and reasonable access to the installation site.

4.3  You must inspect Goods on delivery or collection. Any visible transport damage must be noted with the courier or on the delivery note at the time of receipt.

5. Returns and Refunds

5.1 Change of Mind Returns

5.1.1  You may return an unused, unopened Product within 14 (fourteen) calendar days of the date of delivery or collection, provided the Product is in its original, undamaged packaging with all accessories, manuals and proof of purchase included.

5.1.2  Returns requested more than 14 days after delivery, but within 30 (thirty) calendar days, will be subject to a 10% restocking fee. No change-of-mind returns will be accepted after 30 calendar days from the date of delivery.

5.1.3  The cost of returning a Product to us is your responsibility and is non-refundable, unless the return is due to our error or to a defect covered under clause 5.2.

5.1.4  Once a returned Product has been received and inspected, we will notify you whether the return has been approved. Approved refunds will be processed to your original method of payment within a reasonable time, subject to your bank or card issuer's own processing times.

5.2 Damaged or Defective Goods on Arrival

5.2.1  If a Product arrives damaged or is found to be defective on delivery, you must notify us in writing, with clear photographs of the damage or defect, within 24 (twenty-four) hours of receiving the Goods.

5.2.2  Claims for damaged or defective Goods reported after this 24-hour window may not be eligible for a refund or exchange, save where the fault is subsequently found to be a manufacturing defect covered under the Product Warranty in clause 6.

5.2.3  Where a claim relates to a manufacturing fault rather than transport damage, we will log the claim with the relevant Supplier on your behalf, in accordance with clause 2.3.

5.3 Non-Returnable Items

5.3.1  Certain items are not eligible for change-of-mind return, including but not limited to: custom-cut or made-to-order parts, opened consumable filter cartridges and membranes, electrical components once installed, and any item not in a resaleable condition.

6. Product Warranty

6.1  Unless a longer or shorter period is specified on the relevant product listing or invoice, Goods sold by us carry a 12 (twelve) month limited warranty against defects in materials and manufacturing workmanship, as provided by the Supplier or manufacturer of the Product.

6.2  The warranty period begins on the date of purchase, and not on the date of installation, first use, or delivery.

6.3  The following are generally excluded from warranty cover, unless the Supplier's own warranty terms state otherwise:

•          Electrical components such as UV bulbs, transformers, ballasts, pumps and switches, unless proven to be a manufacturing defect.

•          Damage caused by power surges, incorrect electrical installation, or exposure to water or moisture where the component was not designed to be waterproof.

•          Damage caused by freezing, direct sunlight or ultraviolet exposure, unless the Product was specifically designed and marketed for such conditions.

•          Damage from outdoor installation or exposure to the elements without adequate protective housing.

•          Corrosion or rusting of steel or metal parts installed in coastal, high-salinity, or otherwise corrosive environments without suitable protection.

•          Damage caused by incorrect use, neglect, insufficient maintenance, or failure to follow the maintenance schedule provided with the Product.

•          Damage caused by repairs, alterations or installation carried out by unauthorised or unqualified persons.

•          Movable parts such as taps, valves, pumps and switches, unless proven to be a manufacturing defect.

6.4  To log a warranty claim, contact us with your proof of purchase, a description of the fault, and, where possible, supporting photographs or video. We will assess the claim and, where the fault appears to be a manufacturing defect, escalate it to the relevant Supplier for their assessment, repair, replacement, or other resolution in line with their warranty process. Turnaround times for Supplier-assessed claims are determined by the Supplier and are outside of our direct control.

6.5  This warranty is in addition to, and does not limit, any rights you may have under the Consumer Protection Act 68 of 2008 or other applicable South African consumer legislation.

7. Limitation of Liability

7.1  As a reseller, our liability in respect of any Product defect, malfunction, or failure is limited to facilitating a repair, replacement, or refund through the responsible Supplier, in accordance with clauses 2, 5 and 6 above.

7.2  To the maximum extent permitted by law, we will not be held liable for any indirect, incidental, or consequential loss or damage, including but not limited to water damage, property damage, or loss of use, arising from the installation, use, or failure of a Product, except where such loss arises directly from our own gross negligence.

7.3  Nothing in these Terms is intended to exclude or limit any liability which cannot lawfully be excluded or limited under South African law.

8. General

8.1  These Terms are governed by the laws of the Republic of South Africa.

8.2  We may update or amend these Terms from time to time. The version in effect at the time an Order is placed will apply to that Order. The revision number and date at the top of this document indicate the current version.

8.3  If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

8.4  For any queries relating to these Terms, an Order, a return, or a warranty claim, please contact us using the details below.
